September 3rd, 2008 ROOSEVELT — Duchesne Countys former chief law enforcement officer was jailed Tuesday, suspected of driving under the influence of prescription drugs. Karen Allen, who served an appointed term as county attorney from 2004 to 2006, was arrested following a single-car accident that occurred as she was driving to the 8th District Court building in Duchesne to file paperwork. Utah Highway Patrol trooper Rex Olsen said Allen lost control of her car at about 11 a.m. and slid off an embankment on the right side of the road. Allen was uninjured in the crash and was cooperative with authorities, Olsen said, but refused to submit to field sobriety testing. She was booked into jail on suspicion of misdemeanor DUI and improper lane travel.
The Missouri Court of Appeals in St. Louis separated itself from its Kansas City counterpart in a decision dealing with the time an alleged drunken driver has to contact an attorney. Associate Circuit Judge John Jackson relied on a 2006 decision out of the Western District Court of Appeals when he reinstated Paxtons driving privileges. In Schussler v. Fisher, the Western District said that “whether the request to speak to an attorney comes before or after the Implied Consent Law is read, section 577.041.1s twenty-minute waiting period begins running immediately after the officer has informed the driver of the Implied Consent Law.” But the Eastern District panel said Schussler is “contrary to the express language of Section 577.041.1″ and declined to follow the decision. The law itself instructs police officers to give drivers 20 minutes to try to reach an attorney after they ask to speak to one. The panels decision was unanimous.
